Om Vault — Terms of Service

1. Acceptance of Terms

By accessing or using Om Vault ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Continued use of the Service after any modification to these Terms constitutes acceptance of those changes.

2. Account Eligibility

Om Vault is an invite-only platform. Access is granted solely at the discretion of Om Vault's administrators. To use the Service, you must:

• Be at least 18 years of age
• Have received a valid invitation from an authorised Om Vault administrator
• Provide accurate information during account creation (via Google Sign-In or linked messaging accounts)

3. User Responsibilities

As a user of Om Vault, you agree to:

• Use the encrypted vault solely for storing your own personal files, documents, and photos
• Keep your account credentials and linked accounts secure
• Not share your account access with others
• Use the Service for lawful personal purposes only
• Comply with all applicable laws and regulations

4. Prohibited Use

You may not use Om Vault to:

• Store, transmit, or distribute any illegal, harmful, or objectionable content
• Store content that violates intellectual property rights of others
• Attempt to circumvent, disable, or interfere with the encryption or security mechanisms of the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service for commercial redistribution or resale
• Attempt to gain unauthorised access to other users' vaults or data
• Use automated tools to scrape, crawl, or harvest data from the Service

5. Intellectual Property

Om Vault's property: The Om Vault platform — including its source code, design, branding, UI components, APIs, and documentation — is the exclusive intellectual property of Om Vault and its creators. All rights are reserved.

Your content: You retain full ownership of all files, photos, and documents you upload to Om Vault. We claim no rights over your content. By using the Service, you grant Om Vault a limited, technical licence solely to store, encrypt, and deliver your files back to you.

6. Data Handling

Our handling of your personal data is governed by the Om Vault Privacy Policy. Key guarantees:

• All files are encrypted at rest using AES-256-GCM with Argon2id key derivation
• All data in transit is protected via HTTPS/TLS
• Each user has isolated, per-user encrypted storage
• Account deletion permanently and irreversibly removes all data

7. Third-Party Integrations

Om Vault integrates with the following third-party services:

• Google Drive: Used for optional import of files. Access is read-only and user-initiated. Om Vault does not modify or delete files on your Google Drive.
• Amazon S3: Used for encrypted cloud backup and optional bulk import. Access is read-only for imports and write-only for backups, always user-initiated.
• Google Gemini (via OpenRouter): Used for optional AI tagging and document intelligence, only with explicit user consent.

Third-party integrations are activated only when you explicitly initiate them. Om Vault does not share your data with third parties for advertising, analytics, or any purpose other than providing the Service.

8. Service Availability

Om Vault is provided on a "best effort" basis. We do not guarantee any specific uptime, availability, or performance level. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Infrastructure issues beyond our control
• Security incidents requiring immediate action

We will make reasonable efforts to notify users of planned downtime but are not obligated to do so.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Om Vault is provided "as is" and "as available" without warranties of any kind, express or implied
• Om Vault shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Om Vault's total liability shall not exceed the amount paid by you (if any) for the Service in the 12 months preceding the claim
• Om Vault is not liable for data loss resulting from user error, account deletion, or force majeure events

10. Termination

Om Vault reserves the right to suspend or terminate your account at any time if:

• You violate these Terms of Service
• Your use poses a security risk to the platform or other users
• You engage in prohibited activities as described in Section 4
• Required by law or legal process

Upon termination, your encrypted data will be permanently deleted in accordance with our data retention policy. You may also delete your account voluntarily at any time from Account Settings.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

12. Applicable Legislation

Om Vault operates in compliance with the following Indian legislation:

• Information Technology Act, 2000: Compliance with provisions relating to electronic records, data protection, and intermediary obligations
• Digital Personal Data Protection (DPDP) Act, 2023: Compliance with data principal rights, consent management, and data fiduciary obligations
• Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021: Compliance with intermediary due diligence and grievance redressal requirements

13. Dispute Resolution

In the event of any dispute arising from these Terms:

• Amicable resolution: Both parties shall first attempt to resolve the dispute amicably through direct communication within 30 days of written notice
• Arbitration: If amicable resolution fails, the dispute shall be referred to binding arbitration in Bengaluru, Karnataka, conducted in English under the Arbitration and Conciliation Act, 1996
• The arbitral award shall be final and binding on both parties
